RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
In consideration for being permitted to participate in the Recess Revolution Creative and Collaborative Play Workshop and related activities (“Activities”), I agree as follows:
1. ASSUMPTION OF RISK
I understand that participation in the Activities involves inherent risks, including but not limited to falls, collisions, use of equipment, uneven surfaces, and other hazards that may result in serious injury, permanent disability, or death.
I knowingly and voluntarily assume all such risks, both known and unknown, arising from the inherent risks of the Activities and/or the ordinary negligence of Recess Revolution, its owners, officers, employees, agents, volunteers, and property owners (“Released Parties”).
2. RELEASE OF LIABILITY
To the fullest extent permitted by California law, I hereby release and discharge the Released Parties from any and all claims or causes of action for ordinary negligence arising out of my participation in the Activities.
This release does not apply to gross negligence, reckless conduct, or intentional misconduct.
3. AGREEMENT TO FOLLOW RULES / SELF-MONITORING
I agree to follow all posted and verbal safety rules and instructions. If I observe any unsafe condition, I will immediately stop participating and notify staff.
4. MEDICAL FITNESS
I certify that I am physically able to participate and have no condition that would make participation unreasonably dangerous.
5. LIMITED INDEMNIFICATION
I agree to indemnify and hold harmless the Released Parties only for claims brought by third parties arising from my own negligent or intentional conduct during participation.
6. SCOPE OF AGREEMENT
This agreement applies only to injuries or damages arising from participation in the Activities and use of the premises during the time of participation.
7. SEVERABILITY
If any portion of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
8. FOR PARTICIPANTS OF MINORITY AGE
(BELOW THE AGE OF 18)
This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all Releases, and for myself, my heirs, assigns, and next of kin, I release and agree to indemnity and hold harmless the Releasees from any and all liabilities incident to my minor child's involvement or participation in these programs as provided above. EVEN IF ARISING FROM THEIR NEGLIGENCE.
9.Electronic Signature Consent and Validity
I, the undersigned, agree that by signing this waiver electronically, I am adopting this electronic signature as my legal signature, and it shall have the same legal force and effect as a handwritten signature for all purposes. I consent to be legally bound by this agreement, and I acknowledge that I have received a copy of this document. I also acknowledge that I have had the opportunity to review the terms in a non-electronic format, if I so desired, and that my signature on this document is as valid as if I signed the document in writing.
10.ACKNOWLEDGMENT OF UNDERSTANDING
I have read this agreement carefully and understand that I am giving up certain legal rights, including the right to sue for ordinary negligence. I sign this agreement voluntarily.
